TERMS AND CONDITIONS AND PURCHASE AGREEMENT

Entry to the performance site constitutes an agreement to the terms and conditions and purchase agreement outlined below. This is a legal document that describes your rights and responsibilities as a ticket holder and website user, including important information on the purchase of tickets

Booker Visual and Performing Arts Center (BVPAC) has taken every reasonable precaution to ensure the safety and security of patrons attending performances and will continue to provide the highest quality of customer care when dealing with customer related issues.

HEALTH ADVISORY: Booker Visual and Performing Arts Center would like to inform you that the performance may contains multiple sequences of flashing lights, fog, smoke and laser light effects which may cause difficulties for people with photosensitive epilepsy. Please consider this before purchasing tickets.

1. ASSUMPTION OF RISK

1.a. By attending a BVPAC event or using related services, you voluntarily assume all risks and waive the right to hold Booker High School, the Sarasota County School Board, BVPAC staff, or affiliated parties liable for personal injury, illness, death, property damage, financial loss, delays, or disruptions arising out of your attendance or participation.

1.b. You agree that BVPAC and its affiliates are not responsible for indirect, incidental, or consequential damages, including those resulting from technical failures, transmission errors, acts of third parties, viruses, or venue conditions. Your sole remedy is to discontinue use or leave the event.

1.c. BVPAC is not responsible for the behavior of other attendees or third parties during performances.

1.d. BVPAC disclaims responsibility for any loss or inconvenience caused by events beyond its reasonable control, including but not limited to weather, power failure, natural disaster, government action, labor disputes, or facility malfunction.

1.e. The maximum liability of BVPAC, Booker High School, and the Sarasota County School Board shall not exceed the original ticket purchase price. No claim for damages or refund may exceed this amount.

2. COPYRIGHT, PHOTOGRAPHY & VIDEO

2.a. All content presented during performances at BVPAC—including scripts, music, choreography, visual design, staging, and associated intellectual property—is protected under U.S. and international copyright law.

2.b. Recording or reproduction of any kind is strictly prohibited, including audio, video, livestreaming, or still photography, unless prior written permission is obtained from the applicable rights holders. This prohibition applies regardless of intent or audience, including personal use, educational review, or archival purposes.

2.c. The license to perform a show does not include the right to record it. Recordings made for internal use, classroom instruction, or personal memento are still prohibited without a separate written license.

2.d. Unauthorized recording may result in removal from the venue, cancellation of ticket privileges, referral for disciplinary action (if applicable), and potential civil liability under federal copyright law.

2.e. For events where photography or brief video is expressly permitted, attendees may take non-flash, below-shoulder-level photos using a personal mobile device. Full-scene recording, flash photography, or use of professional equipment remains prohibited at all times unless explicitly authorized.

2.f. By entering the venue, you grant BVPAC the right to use your image, likeness, or voice in any authorized recording, publication, or promotional material, in any format, without compensation.

3. ADA COMPLIANCE

3.a. BVPAC complies fully with the Americans with Disabilities Act (ADA). Patrons requiring accessible seating, assistive listening devices, or additional accommodations are encouraged to contact the Ticketing Agent or BVPAC staff as early as possible. All reasonable efforts will be made to meet accessibility needs.

4. CHANGES TO SHOWS OR SCHEDULE

4.a. All sales are final. No changes or cancellations may be made after a ticket order is completed.

4.b. BVPAC reserves the right to cancel or modify any performance, including but not limited to date, venue, pricing, cast, showtime, or capacity, at its sole discretion and without prior notice.

4.c. In the event of a cancellation, refunds will be issued directly by the Ticketing Agent to the payment method provided at the time of purchase. Processing may take 5–7 business days.

4.c.i. If a performance is canceled immediately before or during the event, refunds will be issued at the next available opportunity. Proof of purchase may be required.

4.d. Changes to program content, including cast substitutions, do not entitle ticket holders to a refund.

5. TICKET TERMS

5.a. All prices are listed in U.S. dollars (USD).

5.b. Infants under 2 years may be admitted free if seated on a guardian’s lap. Children ages 2–12 require a child ticket. Teens (13–17) require a student or adult ticket, depending on the event. Adults (18+) must purchase general admission tickets.

5.c. Discounted, complimentary, or promotional tickets are non-refundable and may not be resold.

5.d. Resale of tickets is strictly prohibited. BVPAC reserves the right to deny entry to the holder of a resold ticket.

5.e. A non-refundable convenience fee will be charged by the Ticketing Agent and displayed at checkout. This fee covers administrative and technical costs.

5.f. BVPAC reserves the right to cancel ticket orders at its discretion.

5.g. A valid government-issued photo ID may be required upon entry.

5.h. Ticketing data, excluding payment information, is managed and retained by the Ticketing Agent in accordance with its privacy policy.

5.i. All advertised prices are subject to change.

5.j. Seat reservations are only guaranteed after full payment. Unpaid or partially paid reservations will be held for 30 calendar days and may be released thereafter without notice.

6. SOCIAL MEDIA & DIGITAL CONDUCT

6.a. Participation in BVPAC’s digital spaces, including social media, is subject to basic standards of courtesy and respect. Content deemed defamatory, offensive, disruptive, spam-based, or irrelevant may be removed without notice. Repeat violations may result in account blocking or referral for disciplinary review if applicable.

7. MERCHANDISE

7.a. All merchandise purchases are final. No refunds, exchanges, or upgrades are permitted unless required by applicable law.

8. INDEMNIFICATION

8.a. You agree to indemnify, defend, and hold harmless Booker Visual and Performing Arts Center, Booker High School, the Sarasota County School Board, and their respective employees, agents, and representatives from any claims, losses, damages, or expenses (including legal fees) arising from your violation of these Terms, misuse of the venue or website, or infringement on third-party rights.

8.b. The maximum financial liability for all claims shall not exceed the original purchase price of the ticket(s).

9. GOVERNING LAW

These Terms and Conditions are governed by the laws of the State of Florida. Any legal disputes shall be brought exclusively in a court of competent jurisdiction located in Sarasota County, Florida. BVPAC and Booker High School operate under the Sarasota County School Board and are entitled to the protections of sovereign immunity under Florida law.

10. CONCESSIONS

10.a. BVPAC may offer food, beverages, and other consumables during select performances. Concession availability is subject to change and is not guaranteed at all events.

10.b. All concession items are provided “as is.” BVPAC, Booker High School, and the Sarasota County School Board make no warranties—express or implied—regarding the quality, nutritional content, or allergen safety of any item sold or distributed at the venue.

10.c. By purchasing or consuming any food or beverage on-site, you acknowledge and accept full responsibility for any adverse reaction, injury, illness, or dissatisfaction. This includes but is not limited to foodborne illness, allergic reactions, or contamination from external sources.

10.d. BVPAC does not guarantee an allergen-free environment. Individuals with food sensitivities, allergies, or dietary restrictions are encouraged to exercise caution and ask concession staff for available ingredient information.

10.e. You agree to indemnify and hold harmless Booker Visual and Performing Arts Center, Booker High School, the Sarasota County School Board, and all related personnel from any claims, losses, or damages (including medical costs or legal fees) resulting from the consumption of concessions or related products on-site.
